Resumr Legal
Terms of Use
Last updated
The short version
- You own what you create. We use it only to run Resumr for you.
- Use Resumr honestly and lawfully, and keep your account secure.
- Resumr is free today. We’ll never charge you without your clear agreement.
- Resumr is provided as is, and our liability is limited.
- Disputes go to individual arbitration, not class actions, unless you opt out within 30 days.
This summary is for convenience. The full text below is what applies.
1. Agreement to these Terms
These Terms of Use (“Terms”) are a binding agreement between you and Resumr (“Resumr,” “we,” “us” or “our”). They govern your use of getresumr.com, the Resumr app, and any related services, features, templates and content we provide (together, the “Service”).
By creating an account, or by accessing or using the Service, you confirm that you have read and agree to these Terms and to our Privacy Policy and Cookie Policy, which are part of these Terms. If you don’t agree, don’t use the Service.
Please read Section 18, “Dispute resolution and arbitration,” carefully. It requires most disputes to be resolved by binding individual arbitration instead of in court, and it waives your right to a jury trial and to take part in a class action. You can opt out within 30 days, as explained in Section 18.8.
2. Who can use Resumr
You may use the Service only if you can form a binding contract with us and aren’t barred from using it under applicable law. In particular:
- You must be at least 13 years old. If you’re under 18, or under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf.
- You must not be located in a country subject to a comprehensive U.S. embargo, or be on a U.S. government list of prohibited or restricted parties.
- If you use the Service on behalf of an organization, you confirm that you have authority to accept these Terms for it, and “you” includes that organization.
3. Your account and security
You create an account with your name, email address and a password. You may later add other ways to sign in, such as passkeys, email sign-in links, or a connected Google, Apple, Microsoft or GitHub account, and you may turn on 2-step verification.
You are responsible for your account and for everything that happens in it. You agree to:
- Provide accurate information and keep it up to date.
- Keep your password, passkeys, authenticator app and other sign-in methods secure and confidential.
- Not share your account, sell or transfer it, or let anyone else use it.
- Tell us promptly through the Contact page if you believe someone has accessed your account without permission.
We may require you to verify your identity or take security steps, and we may refuse a sign-in that appears unauthorized. We aren’t responsible for losses caused by someone using your sign-in methods, unless the loss was caused by our own failure to take reasonable care.
4. Your content
“Your Content” means everything you put into the Service: your profile, resumes, CVs, cover letters, photos, files, job tracker entries, notes, and anything you upload or type.
4.1 You own it
As between you and us, you own Your Content. We don’t claim ownership of it.
4.2 Permission you give us
You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display and adapt Your Content only as needed to provide, secure and improve the Service for you. This includes saving it, rendering previews, converting it into files you download, and showing anything you choose to share through a share link or public profile. We may let our service providers do the same on our behalf, under confidentiality obligations.
This license ends when you delete Your Content or your account, except for copies kept in backups until they expire on a normal schedule, copies you’ve shared that others have already saved, and anything we must keep to comply with the law.
We don’t sell Your Content, use it for advertising, or use it to train artificial intelligence models.
4.3 Your responsibility
You confirm that you have all rights needed to put Your Content into the Service and to grant the license above, and that Your Content doesn’t violate these Terms, the law, or anyone’s rights, including privacy, publicity and intellectual property rights.
You are responsible for the accuracy of your documents. Review everything before you send it to an employer, school or anyone else.
4.4 Keep your own copies
We work hard to keep Your Content safe, but no service can promise against every loss. You can download your documents and a full export of your data at any time, and we recommend keeping your own copies of anything important.
5. The Service, templates and our rights
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal or professional purposes.
You may use Resumr’s templates to create documents for any lawful personal or professional purpose, including sending them to employers, recruiters, schools and anyone else. Your downloads have no watermark and don’t need to credit Resumr.
The Service, including its software, templates, designs, text, graphics, logos and the “Resumr” name, belongs to us and our licensors and is protected by intellectual property laws. Except for the license above, these Terms give you no rights in the Service. You may not:
- Sell, resell, license, or redistribute the templates themselves, alone or as part of another product.
- Copy, modify, or create derivative works of the Service, except your own documents.
- Reverse engineer, decompile or disassemble the Service, except where the law expressly allows it.
- Use the Service, or any data from it, to build or train a competing product.
- Remove or change any proprietary notices, or use our name or logos in a way that suggests we endorse you.
6. Acceptable use
You agree not to use the Service to, or attempt to:
- Impersonate any person or organization, or create documents with false credentials, degrees, employers or references meant to deceive.
- Upload or share content that is unlawful, defamatory, harassing, hateful, sexually explicit, violent, or that exploits minors.
- Infringe or misappropriate anyone’s intellectual property, privacy or publicity rights.
- Upload malware, or content designed to harm devices, systems or people.
- Access another person’s account or data, or get around authentication, security, rate limits or other usage limits.
- Probe, scan or test the Service for vulnerabilities, except through responsible disclosure as described on our Security page.
- Overload, disrupt or interfere with the Service, or use bots, scrapers or other automated tools to access it without our written permission.
- Send spam or unsolicited messages through share links, public profiles or the contact form.
- Violate any applicable law, including export control and sanctions laws.
We may investigate violations and remove content, limit features, or suspend or close accounts that break these rules, as described in Section 14.
8. Optional AI features
Some features may use artificial intelligence, for example to suggest wording. These features are optional. Where they use an AI provider you connect with your own API key, the text you choose to send is processed by that provider under its own terms, and you are responsible for your use of that provider.
AI suggestions can be inaccurate, incomplete or inappropriate. Review and edit anything an AI feature produces before you use it. You’re responsible for the documents you send.
9. Third-party services
The Service may link to or work with services we don’t own or control, such as Google, Apple, Microsoft and GitHub sign-in, AI providers you connect, and websites you link to in your documents. Your use of them is governed by their own terms and privacy policies, and we aren’t responsible for them.
10. Free service and paid plans
The Service is currently free. If we introduce paid plans, we’ll publish their prices and terms on our Pricing page before anything is billed, they’ll be optional, and we’ll ask for your clear agreement before charging you. Features you already use for free won’t start billing on their own. Any paid plan will have its own billing terms, which will be part of these Terms.
11. Feedback
If you send us ideas, suggestions or other feedback, you agree that we may use them for any purpose without obligation or payment to you. Feedback doesn’t include Your Content.
12. Copyright complaints
We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act (“DMCA”). If you believe content on the Service infringes your copyright, send a notice through the Contact page (choose “Legal”) that includes:
- Your physical or electronic signature.
- Identification of the copyrighted work you believe is infringed.
- Identification of the material you believe is infringing, with enough information for us to find it, such as a share link.
- Your name, address, telephone number and email address.
- A statement that you have a good-faith belief that the use isn’t authorized by the copyright owner, its agent or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act for the owner.
If your content was removed and you believe that was a mistake, you may send a counter-notice with the information required by 17 U.S.C. § 512(g)(3). We may restore the content unless the complaining party files a court action within the time the law allows.
We close the accounts of repeat infringers in appropriate circumstances. Knowingly false notices can result in liability for damages.
13. Changes to the Service
We’re always improving Resumr, so features, templates and the Service itself may change, and some may be added or removed. If we plan to remove a significant feature you use, we’ll give reasonable notice where we can. You can download your documents at any time.
14. Suspension and termination
You may stop using the Service and delete your account at any time from Settings.
We may suspend or end your access, or remove content, if you materially or repeatedly break these Terms, if your use creates a risk or legal exposure for us or others, if we’re required to by law, or if we stop offering the Service. Where we reasonably can, we’ll tell you first and give you a chance to download your documents. We won’t be liable to you for suspending or ending access as these Terms allow.
Sections that by their nature should survive termination will survive, including Your Content (the parts about our license ending), our rights, Feedback, Disclaimers, Limitation of liability, Indemnification, Dispute resolution, Governing law, and General terms.
15. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We don’t warrant that the Service will be uninterrupted, secure or error-free, that defects will be corrected, or that any content, file or document will be accurate or will be read correctly by any employer, school or applicant-tracking system.
Resumr helps you create and format documents. It can’t guarantee interviews, job offers, admissions or any other result. Features like Page Limit, the readability check and the export check are guides, not guarantees. Some states don’t allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law, Resumr and its affiliates, officers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, opportunity or employment, arising out of or relating to these Terms or the Service, even if we have been told such damages are possible.
Our total liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
These limits apply to every theory of liability, including contract, tort (including negligence), strict liability and statute, and even if a remedy fails of its essential purpose. They don’t limit liability that can’t be limited by law, such as for fraud, gross negligence or willful misconduct, or for death or personal injury caused by our negligence. Some states don’t allow these limits, so they may not apply to you.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify and hold harmless Resumr and its affiliates, officers, employees and agents from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of Your Content, your use of the Service, or your violation of these Terms, the law or anyone’s rights. We may take control of the defense of any such claim at our expense, and you’ll cooperate with us.
18. Dispute resolution and arbitration
This section affects your legal rights. Unless you opt out (Section 18.8), you and we agree to resolve disputes through binding individual arbitration and waive the right to a jury trial and to bring or join a class action.
18.1 Try to resolve it first
Before starting arbitration or a small-claims case, the party with a dispute must send the other a written notice describing it and the relief requested. Send yours through the Contact page (choose “Legal”); we’ll send ours to the email address on your account. For 60 days after the notice, we’ll both try in good faith to resolve the dispute informally, including in a phone or video call if either of us asks. Any time limits are paused during these 60 days.
18.2 Agreement to arbitrate
If we can’t resolve it informally, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service, including its formation, scope, validity or enforceability (a “Dispute”), will be resolved by binding individual arbitration, except as set out in Section 18.3. This agreement is governed by the Federal Arbitration Act (9 U.S.C. § 1 et seq.).
18.3 Exceptions
Either of us may instead (a) bring an individual claim in small-claims court if it qualifies and stays there, and (b) ask a court for an injunction to stop the infringement or misuse of intellectual property rights or unauthorized access to the Service. Nothing in this section stops you from bringing an issue to the attention of a government agency.
18.4 How arbitration works
The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as modified by these Terms, before a single neutral arbitrator. The arbitration may be held by video, by phone or on written submissions, or in person in the county where you live if you prefer. The arbitrator may award the same individual relief a court could, but only to you individually and only as needed for your individual claim. The arbitrator’s decision is final and can be entered as a judgment in any court with jurisdiction.
If you start arbitration, you’ll pay no more in filing fees than you would to file in court, and we’ll pay the rest of the AAA fees as its Consumer Rules require. Each party pays its own attorneys’ fees, unless the arbitrator awards them under applicable law. If the arbitrator finds a claim frivolous or brought for an improper purpose, fees will be allocated as the AAA rules allow.
18.5 No class actions and no jury
You and we may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. You and we waive any right to a jury trial.
If a court decides that this class waiver can’t be enforced for a particular claim or remedy, that claim or remedy (and only that one) will be decided in court under Section 19, after any arbitration of the remaining claims, and not in class arbitration.
18.6 Many similar claims
If 25 or more similar demands are filed against us by or with the help of the same or coordinated counsel, the AAA’s Mass Arbitration Supplementary Rules will apply, the claims will be resolved in batches of up to 100 (with one arbitrator per batch), and time limits for the claims will be paused while they wait. Both sides agree to cooperate to resolve them as efficiently as possible.
18.7 If part of this section is invalid
If any part of this Section 18 is found unenforceable, the rest still applies, except that if the class waiver in Section 18.5 is found unenforceable for all claims, this entire Section 18 won’t apply.
18.8 Your right to opt out
You can opt out of this agreement to arbitrate by sending us a notice within 30 days after you first agree to these Terms. Send it through the Contact page (choose “Legal”) and include your name, the email address on your account, and a clear statement that you want to opt out of arbitration. Opting out won’t affect any other part of these Terms, or any earlier agreement to arbitrate you made with us.
18.9 Changes to this section
If we make a material change to this Section 18, you may reject it by notifying us within 30 days after the change takes effect, as in Section 18.8. Rejecting a change means the most recent version of this section you accepted continues to apply.
19. Governing law and venue
These Terms and any Dispute are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act for Section 18. Any Dispute not subject to arbitration, or where arbitration doesn’t apply, will be heard only in the state or federal courts located in the State of Delaware, and you and we consent to their personal jurisdiction. This doesn’t take away any protections of the consumer laws where you live that can’t be waived by contract.
20. Time limit for claims
To the extent permitted by law, any claim arising out of or relating to these Terms or the Service must be brought within one year after it arises, or it is permanently barred.
21. Export and sanctions
The Service is operated from the United States. You agree to comply with all U.S. and other applicable export control and economic sanctions laws in your use of the Service.
22. Electronic communications
By using the Service, you agree to receive communications from us electronically, such as emails, in-app messages and notices on this website, and you agree that they satisfy any legal requirement that a communication be in writing. Messages about your account and security aren’t optional while you have an account.
23. General terms
- Entire agreement. These Terms, with the Privacy Policy, Cookie Policy and any terms for specific features we present to you, are the entire agreement between you and us about the Service and replace any earlier agreements.
- Assignment. You may not assign or transfer these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization or sale of assets, or by operation of law.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible, and the rest of these Terms will stay in effect.
- No waiver. Our failure to enforce a provision isn’t a waiver of our right to do so later.
- Force majeure. We aren’t liable for delays or failures caused by events beyond our reasonable control, such as outages of internet or hosting providers, natural disasters, war, labor disputes or government action.
- No third-party beneficiaries. These Terms don’t give rights to anyone else.
- Relationship. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship.
- Interpretation. Headings are for convenience only. “Including” means “including without limitation.” If we translate these Terms, the English version controls.
24. Notice for California users
Under California Civil Code § 1789.3, California users are entitled to the following notice: the Service is currently provided free of charge. You may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
25. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll change the “Last updated” date above. If a change is material, we’ll tell you in the app or by email at least 30 days before it takes effect, unless the change is required sooner by law or to address security or misuse. If you keep using the Service after a change takes effect, you accept the updated Terms. If you don’t agree, stop using the Service and delete your account.
26. Contact
Questions about these Terms, legal notices, and arbitration opt-outs: email legal@indr.app, or use the Contact page and choose “Legal.”
